Having an Issue With an Insurance Company?

I’m trying to see if anyone would know what the next step would be if a claim is denied. I was at a fast food restaurant sitting in the drive thru. While I was waiting, snow and ice fell on my windshield cracking and chipping it. When the ice fell, I looked at the girl in the drive thru and asked if they cleaned off the roof. She apologized and said they were trying their best to keep the roof clean. I drove out of the drive thru and that’s when I noticed the chip and *****. I called the store back and the gentleman told me that he couldn’t help me but to call back and speak to a GM. I did and ended up taking my car up there so that they can take pictures of the damage. I told the GM I was going on vacation in a few days, and I needed to get it repaired because my car was going to be sitting outside in the snow and I didn’t want the ***** to spider out. He told me ok and that he will contact his insurance company and see about getting me reimbursed. I got my windsheild repaired for $53. I just talked to the insurance company today and I was told my claim would probably be denied on liability because it was through no fault of the restaurant and she knew for a fact they were up their shoveling the roof. If the claim is denied, is there another route I can take to attempting to get reimbursed?

you schould have called police and make a report of it now that it is too late i guess youre on your own
sure take it through small claims, its a 50 50 bet, but if you lose you are out court filiing fees, and process server
Follow this up. A drive up, be it fast food or bank, has to look after the customer’s interest. If you have a receipt the company could pay it out of their petty cash and not even miss it.
Write to the head branch of the company and attach a photocopy of the receipt.
You should have and you may still be able to use your own insurance to pay for the windshield. Once they pay, then they will go after the food joint to try get both you and them reimbursed. BTW… You “beef” is with the food joint, not their insurance company. The food joint did what I’m advising you to do. They are letting their insurance company argue with you so they don’t have to. You need to use the same smart tactics. Let your company fight and argue with the food joint. They are experts. Let them do the job you “hired” them to do when you bought insurance. Contact your insurance company ASAP
